Understanding *Tamlik* (Transfer of Ownership) in Zakat

Introduction

In Hanafi jurisprudence and the fatawa of Aala Hazrat Imam Ahmad Raza Khan (Ψ±Ψ­Ω…Ω‡ Ψ§Ω„Ω„Ω‡ ΨΉΩ„ΩŠΩ‡) in Fatawa Razawiyyah (Volume 10 - Shurut-ut-Tamlik), Tamlik (ΨͺΩŽΩ…Ω’Ω„ΩΩŠΩƒ - Transfer of Ownership) is defined as an indispensable pillar (Rukn) of Zakat.

Without valid Tamlik, Zakat is not discharged.


Section 1: Definition of Tamlik

Tamlik means making an eligible poor Muslim the complete, exclusive, unconditional legal owner of the Zakat funds or items purchased for them.

Section 2: Valid vs. Invalid Zakat Expenditures

Valid Tamlik Examples:

  • Handing cash directly to an eligible poor Muslim.
  • Purchasing clothes, food, or grain and giving them as owned property to a poor family.
  • Depositing money directly into a poor student's personal bank account as their owned gift.

Invalid Expenditures (Lack of Tamlik):

  • Building mosques, minarets, or Islamic centers.
  • Digging public wells or installing public water coolers.
  • Paying salary of mosque imams or staff directly from Zakat funds.
  • Covering general hospital building maintenance.
